Preliminary remarks
The Goldeck Austria Online Shop is an online platform operated under the Internet address goldeckaustria.com by GOLDECK TEXTIL GMBH, company register number: FN 33450 t of the Regional Court of Klagenfurt, Seebacherstraße 11 - 13, A-9871 Seeboden, - hereinafter referred to as "Goldeck Austria" - through which it operates the online mail order business for goods sold at a distance. Goldeck Austria is a brand of GOLDECK TEXTIL GMBH.

Contractual partner
Transactions concluded via the Goldeck Austria Online Shop by way of distance selling (online transactions) are deemed to be concluded exclusively between the respective purchaser and GOLDECK TEXTIL GMBH - hereinafter referred to as Goldeck Austria.

Offers and orders
All offers published on the online platform goldeckaustria.com are non-binding. They are only part of the non-binding range of goods offered on the online platform in terms of scope, subject matter and design.

The respective pictorial representation of the goods offered is non-binding and in particular does not give rise to any legal claim to delivery in a version corresponding to the representation.

Offers invite potential buyers to submit binding purchase offers (orders) to Goldeck Austria for the purchase of the goods presented.

Goldeck Austria reserves the right to accept or reject orders in whole or in part or, insofar as this does not involve any unreasonable change to the object of the respective individual goods order, to change the design (color, manufacturing method, design) at any time.

The order is placed by filling in and clicking on the fields or buttons provided in the online order forms. Various orders for goods can be collected in a shopping cart provided for this purpose and submitted together.

By sending the fully or sufficiently completed online order, the customer submits a binding and - apart from separate rights of withdrawal or return - irrevocable offer to purchase under the conditions defined in the order and undertakes to fulfill them in full.

Goldeck Austria accepts the order upon receipt by sending an order confirmation to the customer and undertakes to deliver the ordered goods in accordance with the applicable terms and conditions.

The acceptance of orders made against prepayment loses its effect after 10 days from the date of the order, unless Goldeck Austria expressly declares otherwise when accepting the order.

When placing an order in Goldeck Austria's online store, the consumer agrees to receive the newsletter. The newsletter can be canceled at any time.

Prices
Unless otherwise stated, the prices quoted for the range of goods offered are final prices and include in particular the statutory value added tax applicable at the registered office of Goldeck Austria.

Insofar as the obligation to pay VAT is transferred to the customer due to the fulfillment of the necessary requirements (reverse charge), the invoice will be issued without charging VAT.

Prices which are only to apply for a certain period of time or for a certain (minimum) quantity of goods must be expressly stated accordingly in the information intended for the customer.

Payment
Payment for the ordered goods shall be made by agreement either in advance, by credit card or by other suitable and generally recognized payment methods customary in online trading.

The selection of the method of payment and the execution of the payment shall take place at the same time as the order is placed.

The conditions applicable to the respective payment methods are set out in detail in the forms provided and to be completed when placing the order.

Goldeck Austria reserves the right to reject orders for the payment method selected by the customer in individual cases or in general.

Retention of title
Irrespective of the other terms of payment and delivery, the acceptance and delivery of orders for goods is always subject to retention of title. Delivered goods remain the property of Goldeck Austria until they have been paid for in full.

Dispatch
Orders for goods shall be dispatched using the usual, suitable and generally recognized methods of dispatch in online trading.

Insofar as the customer has selected a specific mode of shipment in his order, accepting the applicable conditions, the goods will be shipped using the selected mode of shipment.

Shipping costs
With our shipping partner GLS, we deliver your order free of shipping costs to Austria and Germany. Shipping costs of €9.50 will be charged to other countries.

For deliveries to Switzerland, please note that we will charge you the amount calculated with the Austrian VAT and transport/customs clearance costs of € 48.50 will be added. However, this amount includes the Swiss VAT of 8% as well as customs duties that are due on import into Switzerland. For Swiss customers there are no additional costs when buying in our online store, i.e. tax and customs duties are paid by Goldeck Austria.

We do not currently deliver to countries other than those listed.

Returns processing
After receiving your order, you have 14 days to inspect the purchased item and return it if necessary.

The return shipment must be made at your own expense. Goldeck Austria will not assume any costs for this.

Please note the return according to the hygiene regulations: The return must be in the original and unused condition (no test sleep)

Bedding is a hygiene product and is subject to hygiene regulations. For this reason, no used bedding can be returned.

It goes without saying that pillows and comforters must be tried out in order to determine the degree of warmth, height, etc.

However, please make sure that you only try them out in the same way as you would in a store, which means, for example, that you may only place the comforter over your arms for a short time.



Refund

As soon as we have received the return shipment in good order, we will refund the purchase price paid for the goods as follows, depending on the payment method:

Credit card: Refund to your credit card account. You will see the booking on your next credit card statement.
PayPal: Refund to your PayPal account.
Cash in advance: Refund to your bank account.

Delivery
Depending on availability at Goldeck Austria, the goods ordered will generally be delivered to the delivery address stated in the order after receipt and acceptance of the order.

Deliveries to P.O. boxes or consignments made available for post office storage as well as to delivery addresses where no person authorized to accept delivery can be found are excluded.

The goods are deemed to have been duly delivered when the consignment is handed over at the place of delivery. If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us as soon as possible. Failure to make a complaint or contact us has no consequences for the statutory warranty claims of consumers and merely serves to support the provider in asserting his claims against the company commissioned to deliver the goods or the insurance company.

Goldeck Austria cannot assume any liability for the acceptance of the shipment by unauthorized persons. Any liability of the transport or delivery service provider remains unaffected.

As far as technically and organizationally possible, electronic shipment tracking systems are used or made available.

The respective delivery times (time and duration of delivery) are based on the availability of the respective goods as well as on the duration of delivery that can usually be expected or is caused by specific circumstances, including in particular the nature of the goods, the method of shipment, the means of transportation or the place of delivery.

In any case, Goldeck Austria shall not be liable for delays in delivery caused by official requirements, orders or official actions.

Payment of any customs duties, levies or fees at the place of delivery shall be the sole responsibility of the customer.

Goldeck Austria shall be fully indemnified and held harmless by the customer in this respect. Goldeck Austria expressly reserves the right to deliver and to withdraw acceptance of orders for goods at any time to customers who are in arrears with payment for previous deliveries.

Consumers
Customers who are to be regarded as consumers in relation to Goldeck Austria within the meaning of the relevant statutory provisions of the law applicable to the respective transaction shall have a right of withdrawal or revocation as provided therein, which must be asserted within the period applicable under the respective statutory provisions by means of a written declaration in accordance with the respective provisions.

At the same time as the declaration of withdrawal, the delivered or accepted goods must also be duly returned to Goldeck Austria, otherwise the declaration of withdrawal or revocation shall be legally invalid.

Insofar as no longer statutory period is provided for, withdrawal or revocation shall be possible within a period of seven working days from acceptance of the goods, but at the latest after fulfillment of Goldeck Austria's duty to provide information in accordance with the relevant provisions.

In the event of effective withdrawal or revocation, both parties are obliged to immediately return the services received and to surrender any benefits obtained, such as interest income or benefits of use or enjoyment. Appropriate compensation must be paid for damage to the goods, for loss of value or loss of value or the partial or total loss of the goods.

The return or replacement must be made within 30 days of the declaration of withdrawal or revocation at the latest. The costs of restitution or replacement shall be borne by the respective obligated party, unless otherwise expressly agreed or guaranteed.

Guarantee
For the granting of guarantees, the guarantee commitments declared in connection with the presentation of the respective goods shall apply. The same applies to the exclusion of warranty claims.

Any further guarantee promises declared by manufacturers remain unaffected.

In the event of warranty claims, Goldeck Austria shall only assume or reimburse those costs that are directly associated with the fulfillment of the warranty obligation. Liability for any additional costs is excluded.

Warranty
Goldeck Austria warrants that the delivered goods are free of defects exclusively in accordance with the relevant provisions of the law applicable to the respective transaction. This applies both to warranty periods and to the scope and nature of the respective warranty claims as well as to their possible exclusion.

Compensation for damages
Goldeck Austria shall only be liable for damages caused by intentional or grossly negligent conduct attributable to it. In addition, any damages payable shall in any case be limited to the value of the goods ordered and related to the occurrence of the damage.

Product liability claims can only be asserted against Goldeck Austria in accordance with the relevant provisions of the law applicable to the respective transaction.

Liability for indirect damages is excluded in any case.

Any obligation to compensate Goldeck Austria for loss of profit is excluded in any case.

Insofar as an agreement on the limitation of Goldeck Austria's liability is not permitted under the relevant provisions of the law applicable to the respective transaction, liability shall in any case be deemed limited to the extent permitted. In any case, liability shall be limited to the amount of damages that were typically foreseeable at the time the contract was concluded.

Exclusion of a functional guarantee
Goldeck Austria provides no warranty or guarantee for the function or availability of the Goldeck Austria Online Shop, in particular not for availability at all times.

Technical or electronic errors in the online offer shall not in any case give rise to any liability on the part of Goldeck Austria. Likewise, the unlawful intrusion or unlawful use of data, in particular also access data, which has been collected in connection with the use of the Goldeck Austria Online Shop, shall in any case not give rise to any liability on the part of Goldeck Austria.

If an item is damaged or otherwise unusable, you can submit a complaint to us. We will send you a replacement as soon as possible.

For any disputes arising from transactions made via the Goldeck Austria Online Shop, it is agreed that the court with subject-matter and local jurisdiction for the registered office of Goldeck Austria shall have jurisdiction - to the extent permitted by the applicable relevant provisions.
